First, may I say that if you are reading this, you are probably part way, if not all the way immersed in this very situation, and if so, I extend my heartfelt condolences. I have been through it myself (some years back now) and will never forget what it felt like to be in that position.

If you are beginning the process of divorce, the sale of the house is quite often, and most normally one of the first assets to be sold and proceeds divided. And, it has already occurred to you that listing, negotiating and closing on the sale of your home in the midst of all the pain and confusion can be quite daunting.

   1. Can my spouse sell the house without my agreeing to it?

      In Minnesota, it takes one spouse to purchase a property, and BOTH spouses to sell it. In other words, without two signatures there is no closing. So, you must find a way to cooperate in this.*

   2. If my spouse is the one who bought the house, and was the only one on the title before we got married, do we both still need to sign to sell?

      Yes. (some special situations could change this)*

   3. Can I buy another home or condo right now while we are separated?

      Yes you can, but, YOUR SPOUSE MAY AUTOMATICALLY OWN HALF OF IT!.. So speak with an attorney before you make such a move.*
